Our Obligations
The Queensland Art Gallery | Gallery of Modern Art ('Gallery') is bound by the provisions of the Information Privacy Act 2009 (IP Act), including the Information Privacy Principles. As required under the IP Act, the Gallery protects the privacy of its service users and will only use personal information for lawful purposes consistent with the Information Privacy Principles.
Personal information is defined in the IP Act as 'information or an opinion, including information or an opinion forming part of a database, whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion'. It may include your name, address, phone number, email address, age, gender, your employer, or your job title.
Collection of Information
Wherever possible, the Gallery will collect personal information directly from you with your consent. We collect personal information to help us provide responsive services and to promote and present content relevant to our audience. For example, we ask for personal information when you:
- subscribe to online services
- register for an event or purchase a ticket
- enter an online interactive or competition
- become a QAGOMA Member or Foundation Member
- commence a business relationship with us
- correspond with us or make an enquiry over the internet or telephone.
The Gallery may also obtain your personal information from third parties, such as:
- event organisers, promoters, marketing providers, venues, sponsors and our business partners
- providers of third party applications which collect and share information
- people who provide us with your details to on send packages/gift vouchers
- third parties you refer to us.
If the Gallery collects personal information from third parties you refer to us, we will assume, and you will ensure, that you have made that third party aware of the referral and the purpose of the collection, use and disclosure of the relevant personal information.
This is a Queensland Government website. Email correspondence, comments made on our blog or social media platforms, and information provided via webforms can constitute a public record and can be retained as required by the Public Records Act 2002 and other relevant legislation. Email messages may be monitored by our network support staff for system troubleshooting and maintenance purposes. The Gallery reserves the right to remove comments which it considers to be abusive, defamatory, discriminatory, off-topic, or unlawful.
Social media
This website interfaces with social media sites such as Facebook, Instagram, LinkedIn, Twitter and others. If you choose to 'like' or 'share' information from this website through these services, you should review the privacy policy of that service. If you are a member of a social media site, the interfaces may allow the social media site to connect your visits to this site and elsewhere on the internet with personal information.
When you communicate with the Gallery through social media sites or using applications provided by third parties (such as via your smart phone), your personal information may be collected from that communication (e.g. via Facebook Pixel). We assume that you have informed yourself of the ways in which such sites or applications can collect and disclose your personal information, and that you otherwise consent to the collection, use and disclosure of your personal information by such sites or applications (including disclosure to, and collection by, the Gallery). Check your settings with the relevant social media provider if you wish to opt out of this data collection.
Website analytics
To improve your experience on our website, we may use 'cookies'. A cookie is a small text file that our site may place on your computer as a tool to remember your preferences. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.
The Gallery's website may also use 'session variables' to collect and store information. The Gallery will take precautions to safeguard your personal data from loss, unauthorized access, use, modification or disclosure. As a general rule, we store your personal information in our secure electronic databases.
From time to time, the Gallery may engage service providers to store personal information who could have servers located overseas. We ensure that our service providers are carefully chosen and have policies, procedures and systems in place to keep personal information secure.
At any time, you have the right to access, change, correct or delete your personal information. Please advise us of any errors in your personal information or changes to your personal details, such as address, email address and phone number. You may be asked to provide evidence of your identity before a change can be made.

We may provide marketing communications and targeted advertising to you about events, sponsorship or donation opportunities and other services and products that we think may be of interest to you. We do this by electronic messages (e.g. email), online (including websites and mobile apps), by mail and other means, unless or until your opt out or we are subject to legal restrictions.

The Gallery may disclose your personal information to:

For marketing purposes where it may be impracticable to seek consent, the Gallery may disclose personal data to third parties provided the following apply:
- There is no charge if you indicate that you do not want to receive communications.
- You have not indicated you do not want to receive the communications.
- Each communication prominently displays a notice about opting out of receiving further communications.
- Each communication includes relevant contact information for the Gallery.
We may also share with certain media agencies, publishers and partners, such as Meta and Google, anonymous unique identifiers (‘hashed data’) allocated to you. This identifier may be associated with information collected when you engage with us, for example by subscribing to our e-newsletters, visiting our websites or digital platforms, using our approved agencies, buying a ticket, making a booking, or calling, emailing, faxing or mailing us. This is so that we can provide you with customised content when you visit certain websites and provide other visitors to those websites with customised advertising.

The Gallery website and digital communications may contain links to other websites and services. The Gallery is not responsible for the privacy practices of other websites. When you go to other websites or services from here, we advise you to be aware of and read their privacy policy.
Security of Online Financial Transactions
When you make a payment or purchase through this website your financial details are processed through SecurePay, a wholly owned business of Australia Post. All your details are transmitted securely using a Secure Sockets Layer (SSL). Your credit card details are NOT stored on our servers at any stage of the transaction, and once the credit card details have been sent to our financial institution they are no longer known to our system.
